TERMS AND CONDITIONS

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY

1. Ownership
1.1 Eyes on China Confucius Programs (hereinafter referred to as Confucius Programs) is a part of Eyes on China Ltd., a company based in Alkmaar, The Netherlands, owned by Jan van der Putten.
1.2 As an individual and prospective student, I am now enrolling in, participating in, travelling on, or applying for a Confucius Program, and I agree to the following terms and conditions:

2. Duration of the Program
2.1 I engage myself for the duration mentioned in my application form.

3. Compliance with Rules and Regulations
3.1. During the whole period, mentioned above, of my participation to Confucius Programs I will abide by the rules and regulations of both Confucius Programs and the host university.
3.2. I agree to observe and obey Chinese laws and regulations, and respect Chinese social morality and customs.

4. Insurance
4.1. I understand that all foreign students studying in China must purchase Medical Insurance, and will purchase a health insurance in my home country before my departure covering the whole duration of my stay in China.
4.2. I must show proof of my insurance on my first day of classes during registration procedures.
4.3. Confucius Programs are not responsible for any injury or loss whatsoever suffered by me during periods of the program, during independent travel, during university and/or Confucius Programs activities.
4.4. I agree that Confucius Programs are not responsible for my health problems. I will directly make any insurance claims to the insurance company without the involvement of Confucius Programs.
4.5. In the case of health emergency, Confucius Programs may, without my consent or consent of any parent, guardian, or third party, place me at my own expense in a hospital or other medical institution for medical treatment or other services, or if no such hospital or institution is readily available, Confucius Programs may place me in the hands of and under the discretion of a local medical doctor for treatment.

5. Warranties, Exclusions and Limitations of Liability
5.1. I agree not to sue Confucius Programs (which term shall include directors, the company itself, employees and agents of the company, as well as host institutions and any person or entity employed or utilized by Confucius Programs) for any claims which may arise from, or in connection with, my losses, luggage damage, costs, expenses, delays or loss of enjoyment, of any nature or kind whatsoever, resulting from events beyond Confucius Programs' control, including acts of God, earthquakes, cyclones, storms, flooding, fire, disease, fog, snow or frost, but also strikes, embargoes, lockouts or other labor disputes or disruptions, wars, blockades, accidents, perils of the air, local disputes or civil commotion, insurrections, riots, or acts or restraints imposed by government authorities, or during, without limitation, airlines, transportation companies and railways, bus companies, taxi services, restaurants, student residences, apartments, youth hostels, hotels or host families.
5.2. In case of political or international unrest, Confucius Programs reserve the right and have full authority to take whatever actions deemed necessary, and I (and anyone claiming through me) fully release Confucius Programs from any liability from such actions or any decisions that may be made or taken as a result of such a situation.
5.3. I understand that I am responsible for taking all measures and exercising caution and common sense at all times to avoid injuries and/or death.
5.4. I hereby waive and release all claims against Confucius Programs and their agents arising at any time during the program, (whether I am or am not under the direct supervision of Confucius Programs or their agents), and I agree to indemnify Confucius Programs and their agents against any consequences thereof.

6. Standards of Conduct
6.1 Confucius Programs or the host university shall have the right to enforce appropriate standards of conduct and that it may at any time terminate my participation in my program for failure to maintain these standards or for any actions or conduct which Confucius Programs or host institute considers to be incompatible with the interest, harmony, comfort and welfare of other students or the laws of the People's Republic of China. I shall have no right to any refund of any part of my program fee upon termination of my participation from the program and that upon notice by Confucius Programs, whether verbally or in writing, I shall forthwith depart from the program and to return home at my own expense.

7. Termination of Participation
7.1. If my participation is terminated, I consent to being sent home on my own (or my parents') expense with no refund of fees.
7.2. If I leave the program voluntarily for any reason, I agree there will be no refund of fees already paid.

8. Refunds
8.1. If I may request a refund, I will write an explanation letter detailing the reasons for canceling my participation to the program and send it to Eyes on China Confucius Programs Head Office in Alkmaar, The Netherlands.
8.2. I agree that an administration fee of EUR 100 and the registration fee paid to the Chinese University or Language Institute will not be refunded in any case whatsoever.
8.3. I represent to have read, understood, and comply by the following table stating Confucius Programs Refund Policy.

8.4. In the event that I fail to present myself for the entire or any part of the program, no refund of any fees already paid to Confucius Programs shall be made, unless I have given prior written notice to Confucius Programs stating full reasons, and have obtained prior written approval from Confucius Programs. For the avoidance of doubt, Confucius Programs has the sole discretion, and is not bound to, grant any approval. Further, any periods of absence may not be made up with free extension of the program, unless with the prior consent in writing from Confucius Programs.
8.5. In the event that my visa application is rejected by the Chinese Authorities, I will be entitled to 100% refund of the program fees (excluding an administration fee of EUR 100 and the registration fee paid to the Chinese University or Language Institute), provided that I give Confucius Programs written notice and show the visa rejection letter given by the Chinese Authorities.
8.6. I agree that once the program has started there shall be no refund of program fees.
8.7. In the event that the program I have registered and enrolled in, for whatever reason cannot start on the original intended date, I agree to either accept a refund of program fees (minus the application fee) or to start the program on the next available program closest in date to the original program or defer my program start date until a time which is mutually convenient for me and Confucius Programs (and in any event, within one year of the original application date) and where there is a program scheduled to begin.
8.8. Any bank or transfer fees associated with the refund of the program fees shall be the responsibility of the refund recipient.

9. Cancelation and Changes
9.1. I accept that Confucius Programs or the host institute reserves the right to make any cancelations, changes or substitutions in cases of emergency or changed conditions or in the interest of each group.
9.2. I understand and accept that Confucius Programs or the host institute reserves the right to cancel programs due to insufficient number of registered participants and to reschedule my program start date to another time.
9.3. When there are less than 10 students in a class, Confucius Programs reserves the right to place students at other university programs or defer the program until another date. Confucius Programs reserve the right to cancel any course due to insufficient registration.
9.4 If I want to change from an on-campus to an off-campus accommodation, I accept that (i) refund from payments already made to the host institution cannot be fully guaranteed and that (ii) Confucius Programs will charge me an extra 100 EUR fee for administration costs.
9.5 Services of Confucius Programs' Beijing Helpdesk that go beyond its normal scope will be charged separately, e.g. assistance in preparing non-scheduled trips, organization of transfer to a differerent university or institute during the period the student was registered for, special arrangements for visitors of Confucius Programs students, etc.

10. Visa
10.1. I understand and accept that it is my responsibility to obtain the Chinese visa and in the event I cannot obtain the visa for participation I shall not hold Confucius Programs responsible.
10.2. In the event that my visa application is rejected, I will be refunded 100% only if I meet the requirements stated in the clause 8.5 of this Terms and Conditions.

11. Loan
11.1. If deemed necessary or desirable by Confucius Programs or its agents to advance or loan any monies to me or incur special expense on my behalf while I am abroad, I (and my parents) agree to make immediate repayment upon my return.

12. General
12.1. If any clause of these terms and conditions is held to be unenforceable in whole or in part the other terms and the rest of the provisions shall continue to be valid and enforceable.
12.2. This contract is a binding document. I understand that I should read it carefully and ensure that it contains everything I want and nothing I am not prepared to agree to. These Terms and Conditions constitute the entire agreement between me and Eyes on China for the duration of the Confucius Program of your choice, and supersedes all prior agreements, understandings and representations whether oral or written. I accept without modification all terms, conditions, and notices written in this disclaimer in order to apply to, and participate in, one of the Confucius Programs given by Eyes on China. I understand that if I do not accept these terms in their entirety, I may not apply to, nor participate in any Confucius Program.
12.3. Unless I expressly notify Confucius Programs not to do so in writing, Confucius Programs reserves the right to use any pictures of students, including pictures which I may be a part of or comments made by myself for print, oral, and internet publicity materials and cannot be held liable for such use.
12.4. This agreement shall become effective when my application is accepted by Confucius Programs, and shall be construed and enforced in accordance with, and the rights of the parties shall be governed by, the laws of The Netherlands and/or the People's Republic of China applicable thereto (at the choice of Confucius Programs).
12.5. Confucius Programs reserve the right to make reasonable modifications to the Terms and Conditions of this contract at any time during the term. By continuing to participate in one Confucius Program after the posting of notices regarding such changes, I agree to be bound by such changes. No change will have the effect of requiring an increase in fees from me.
12.6. I expressly acknowledge and agree as a condition of travelling on a Confucius Program that I (and anyone claiming through me) shall have no rights whatsoever, directly or indirectly, under law or in equity against Confucius Programs.
12.7. I hereby grant Confucius Programs and their agents full authority to take whatever actions they may consider to be warranted due to any international or political unrest, personal emergency or other event regarding my health and safety, and I fully release each of them from any liability for such decisions or actions as may be taken in connection therewith.
12.8. Any rights not expressly granted herein are reserved.
12.9. I represent that I have read and agree to abide by this agreement.
